There is no mention of
sick time
pay in any federal or state law. The sick pay
claim depends upon the employment agreement between
an employer and an employee ( e.g., a collective bargaining
agreement), or if it is mentioned in the employer's
policy handbook. Likewise, the employer is not required
to pay employees for accrued sick time when the employment
is ended by any party. Unlike accrued vacation time,
which in some states can be paid in the final paycheck,
sick time cannot be paid as cash under any law. It
depends upon the employer, whether unused sick time
is to be paid for or not. However, some employers
do pay for unused sick time, as an
incentive
for not misusing sick leave.
